Terms of Service

These Terms of Service ("Terms") govern your use of the SpokPay platform operated by Fagner Souza de Jesus Sales, registered under CNPJ 62.886.816. By accessing or using SpokPay, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use SpokPay. By creating an account, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use SpokPay, you must authenticate through Discord. You are responsible for maintaining the security of your Discord account and all activity that occurs under your SpokPay account. You must notify us immediately at legal@spokpay.com if you suspect unauthorized access.

3. The Platform

SpokPay provides a platform for selling digital goods and services through Discord. This includes store management, order processing, payment collection via PIX (through EfiBank), automated delivery, AI-powered customer service, and related features.

4. Store Owner Responsibilities

If you operate a store on SpokPay, you agree to:

• Provide accurate descriptions of the products and services you offer
• Fulfill orders in a timely manner
• Comply with all applicable laws and regulations, including consumer protection laws
• Not sell prohibited items, including but not limited to: illegal goods, stolen accounts or credentials, malware, or any content that violates third-party intellectual property rights
• Handle customer data responsibly and in accordance with our Privacy Policy

5. Customer Responsibilities

If you purchase goods or services through SpokPay, you agree to:

• Provide accurate payment information
• Not initiate chargebacks or disputes in bad faith
• Communicate with store owners through the designated Discord channels

6. Payments and Fees

All payments on SpokPay are processed in Brazilian Real (R$) via PIX through EfiBank. SpokPay charges a platform fee on transactions as described on our Pricing page. Fees are subject to change with prior notice.

Withdrawals are processed to your registered PIX key. Processing times may vary depending on EfiBank's operations.

7. Refunds

Refund policies are set by individual store owners. SpokPay facilitates the refund process but is not responsible for individual store refund decisions. If a dispute arises, SpokPay may intervene at its discretion to mediate.

8. Prohibited Conduct

You may not:

• Use SpokPay for any illegal purpose
• Attempt to circumvent platform fees or security measures
• Interfere with or disrupt the platform or its infrastructure
• Use automated tools to scrape or access the platform without authorization
• Impersonate another person or entity
• Engage in fraud, money laundering, or any financial crime

9. Intellectual Property

The SpokPay name, logo, and platform design are the property of SpokPay. You may not use our branding without prior written permission. Content you upload to SpokPay (product images, descriptions, etc.) remains yours, but you grant us a license to display and distribute it as part of the platform's operation.

10. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any conduct we deem harmful to the platform. You may close your account at any time by contacting us. Pending withdrawals will be processed before account closure, subject to any fraud investigation holds.

11. Limitation of Liability

SpokPay is provided "as is" without warranties of any kind. We are not liable for:

• Losses arising from transactions between store owners and customers
• Service interruptions or data loss
• Actions of third-party services (Discord, EfiBank, etc.)
• Unauthorized access to your account due to your failure to secure your credentials

To the maximum extent permitted by Brazilian law, our total liability is limited to the fees you have paid to SpokPay in the 12 months preceding the claim.

12. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Any disputes arising from these Terms shall be resolved in the competent courts of Brazil.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms. We will notify you of material changes via the platform or email.
